Wazzap.mx – Terms of Service (English)

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Wazzap.mx platform (“Wazzap”, “we”, “our”, “us”), a software-as-a-service (SaaS) solution operated in Mexico that allows businesses to manage and automate communication through WhatsApp and other supported channels.

By creating an account, accessing the platform, or using any of our services, you agree to be bound by these Terms. If you do not agree, you must stop using the service immediately.

2. Nature of the Service

Wazzap provides tools for message management, automation, integrations, and communication flow control.
Wazzap does NOT provide an official WhatsApp API, unless explicitly stated otherwise.
Clients may choose to connect:

  • The non-official WhatsApp API

  • External third-party systems such as n8n, GoHighLevel, Chatwoot, or others

  • Their own devices, credentials, phone numbers, or sessions

These systems are outside of our control and may fail, malfunction, or behave unpredictably.

You understand and agree that:

  • Using non-official WhatsApp API carries risks, including but not limited to:

    • Temporary or permanent bans by WhatsApp

    • Loss of numbers

    • Loss of message history

  • Wazzap cannot recover banned numbers, cannot guarantee uptime of unofficial connections, and cannot prevent Meta/WhatsApp enforcement.

3. Client Responsibility

You, the client, are fully responsible for:

  • The content of all messages you send

  • Your compliance with WhatsApp policies, Meta policies, and local/international laws

  • Any misuse, abuse, spam, illegal messaging, harassment, fraud, or harmful behavior performed using your account

  • Ensuring you have the right to store, transmit, and process the data you upload

Wazzap is not responsible for:

  • Any damage caused by your misuse of the platform

  • Violations of WhatsApp rules

  • Incorrect configurations made by the client

  • Leaks caused by client-side devices, employees, or integrations

  • Any legal liabilities resulting from your business activities

4. Third-Party Integrations

Your use of Wazzap may rely on external systems such as:

  • n8n

  • GoHighLevel

  • Chatwoot

  • Webhooks

  • Custom automations

  • Third-party APIs

  • Phones, emulators, or WhatsApp Web sessions

Since these tools are not owned or operated by Wazzap, we:

  • Do not guarantee their functionality

  • Do not guarantee their uptime

  • Are not responsible for failures, bugs, or vulnerabilities in them

  • Are not responsible for data breaches caused by third-party providers

Your use of third-party tools is governed by their respective Terms of Service.

5. Data Processing & Encryption

To operate properly, Wazzap must read and process your messages.
This includes:

  • Message content

  • Contact data

  • Metadata

  • Automation triggers

  • Connection status

All message transport is encrypted as provided by WhatsApp or the channel, but:

  • Encryption does not guarantee that third-party software, your device, or your browser cannot be compromised.

  • Wazzap cannot guarantee that sensitive data will never leak, especially when using non-official integrations.

  • Wazzap processes data strictly to provide the service and does not sell or share client data for profit.

You acknowledge that no system is 100% secure, and you use the service at your own risk.

6. Service Availability

Wazzap does not guarantee:

  • 100% uptime

  • Uninterrupted service

  • Error-free operation

  • Perfect synchronization

  • That automations will always run

  • That third-party connections will remain stable

Service interruptions may occur due to:

  • WhatsApp blocking

  • Server issues

  • Third-party failures

  • Network outages

  • Meta enforcement

  • Bugs or unplanned glitches

You agree that Wazzap will not be liable for any losses caused by downtime.

7. Payments, Billing & Refunds

  • Service is billed recurring (monthly or annually).

  • Payments are non-refundable.

  • Failure to pay may lead to suspension or deletion of your account.

  • Prices may change with prior notice.

  • No refunds are issued for:

    • Banned numbers

    • Third-party API failures

    • Client misuse

    • Data loss caused by unofficial integrations

8. Prohibited Use

You agree not to use Wazzap for:

  • Spam or mass unsolicited messages

  • Fraud, scams, phishing

  • Harassment or threats

  • Illegal content

  • Hate speech or abusive messaging

  • Pornography involving minors

  • Selling regulated goods without authorization

  • Violations of WhatsApp/Meta policies

Any violation may lead to immediate termination without refund.

9. Termination

Wazzap may suspend or terminate your account if:

  • You violate these Terms

  • You misuse the platform

  • Your activity threatens our infrastructure

  • You perform illegal messaging

  • You damage or attempt to damage the platform

  • Your payments fail

Upon termination:

  • Access to your account may be revoked immediately

  • Data may be deleted permanently

  • No refunds will be provided

You may terminate your subscription at any time through the dashboard.

10. Limitation of Liability

To the maximum extent permitted by law:

Wazzap is not responsible for:

  • Client misuse

  • Third-party failures

  • Illegal or harmful content sent by clients

  • Number bans

  • Data loss

  • Message loss

  • Downtime

  • Lost profits

  • Indirect damages

Your sole remedy for dissatisfaction is to stop using the service.

11. Governing Law

These Terms are governed by the laws of Mexico.
Any dispute shall be handled under Mexican jurisdiction.

12. Changes to These Terms

Wazzap may update these Terms at any time.
Continued use of the service means you accept the updated Terms.
